Among the requirements for a valid Innovator Founder application, one is purely about timing: the endorsement letter must have been issued no more than three months before you apply. Miss that and the issue is not the quality of your business. It is the validity of the application itself.
This rule applies at every stage where you need a letter: the first application, each extension and settlement. This article explains where it sits in the guidance, the situations in which founders run out of time, and how to plan around it.
Where the rule appears
The 3-month rule appears twice in the caseworker guidance, which shows how central it is.
- Validity requirements. For a valid application you need the fee and Immigration Health Charge paid, biometrics, a passport, an endorsement letter issued no more than 3 months before the application date and not withdrawn, and to be aged 18 or over.
- Letter contents. The letter must show a date of issue no earlier than 3 months before the application.
For settlement, the guidance separately requires the endorsement letter to be no more than 3 months old.
| Application | Letter needed | Age limit at application |
|---|---|---|
| Initial (entry clearance or switching) | New-business endorsement | No more than 3 months |
| Extension | Same-business endorsement | No more than 3 months |
| Settlement | Settlement endorsement letter | No more than 3 months |
The common ways founders run out of time
These are general patterns, not statistics; we describe them so you can avoid them.
Getting the letter first and everything else second. The endorsement feels like the hard part, so founders often get it and only then start on English evidence, financial evidence and family documents. The clock started when the letter was issued.
Waiting on the financial requirement. If you have been in the UK for less than 12 months at the date of application, you must show funds held for a 28-day period: £1,270 for the main applicant, £285 for a partner, £315 for the first child and £200 for each further child. A 28-day holding period that starts late eats into your three months. Applicants who have been in the UK for more than 12 months automatically meet the requirement.
Dependants' paperwork. Partners must meet Appendix Relationship with Partner. Gathering evidence for every family member takes time, and each dependant pays their own fee.
Changing passports. The letter must carry your passport number. If you renew mid-process, the letter may need updating before you apply. See what an endorsement letter must contain.
Switching from another visa. If you are switching in the UK, you also have your current visa's expiry date to manage. Our switching timing guide covers how the two deadlines interact.
Plan backwards from your application date
A simple planning approach is to pick a target application date and work back.
- Target application date. Choose it with your current visa expiry (if any) and processing times in mind. GOV.UK says decisions usually take 3 weeks outside the UK and 8 weeks inside, and a faster decision may be available for a fee. The fees table lists priority at £500 and super priority at £1,000.
- Everything except the letter ready first. English evidence at B2 in all four components unless exempt, financial evidence if needed, passport, and dependants' documents.
- Ask your endorsing body about its timeline. Agree when the letter is likely to be issued so that it lands close to your application date, not months before it.
- Apply promptly once the letter arrives. Check its contents, then submit.

Extension and settlement: the same rule, different pressure
At extension, the same-business letter needs to confirm the business is active, trading and sustainable, with significant achievements against the most recently agreed plan, and that you are active in day-to-day management. If your last permission was Innovator Founder, you must have attended at least two contact point meetings. Those meetings are normally after 12 and 24 months, so they feed directly into when your body can write the letter.
At settlement, the letter has a lot to confirm: significant achievements, Companies House registration with you as director or member, active trading, sustainability for at least the next 12 months, your key role in day-to-day management, and at least two of the seven growth criteria. You also need to meet continuous residence (3 years, with no more than 180 days' absence in any 12-month period) and the Knowledge of Life in the UK requirement unless you are 65 or over. Pass Life in the UK and confirm your residence before requesting the letter, so the letter is the last piece, not the first. See the two-of-seven growth criteria and the 180-day rule.
If your endorsing body changes mid-application
The 3-month rule interacts with one more scenario. If your endorsing body is removed or surrenders its status while your application is pending, the guidance says that, unless you were complicit in wrongdoing, the caseworker writes to you allowing 90 days to obtain a new valid endorsement. No new endorsement within 90 days and the application is rejected. See if your endorsing body leaves the list.

Key takeaways
- The endorsement letter must be issued no more than 3 months before you apply; this is a validity requirement.
- The same limit applies at initial application, extension and settlement.
- Prepare English, funds, passport and family documents before the letter is issued, not after.
- If you need to show funds, the 28-day holding period must fit inside your planning window.
- For settlement, sort Life in the UK and continuous residence first so the letter is the final piece.
