Timing your switch: the 3-month endorsement window and your visa expiry

Your endorsement letter must be no more than 3 months old when you apply, and your current permission must still be valid. How to time an in-country switch between the two.

Most switching mistakes are not about the business. They are about dates. An in-country Innovator Founder application has two clocks running at the same time: the shelf life of your endorsement letter and the expiry date of your current visa. Get them out of sync and you can end up with a valid endorsement and no valid way to use it.

This article sets out what the rules say about each clock and how to plan a switch so they line up.

Clock 1: the endorsement letter's 3-month window

The guidance lists the endorsement letter among the validity requirements. It must be:

  • issued no more than 3 months before the application date
  • not withdrawn

The letter must also show the date of issue, the endorsing body's name and reference number, your personal details and the name and contact details of someone at the body who will verify it. Caseworkers verify every endorsement through the Innovator Founder route inbox, so the date on the letter is checked.

The 3-month clock starts on the date of issue, not when you receive it or when you are ready to apply.

Clock 2: your current permission

Suitability rules in the guidance say applicants must not be in breach of immigration law, except for limited overstaying exceptions, and that anyone on immigration bail does not meet suitability except where the Rules allow. In planning terms, treat your current visa's expiry date as a hard deadline for submitting the application.

How the clocks collide

Here are three hypothetical patterns that show how the two clocks can go wrong.

PatternWhat happensWhy it is a problem
Endorsed too earlyLetter issued in January, visa expires in JuneLetter is more than 3 months old by the time you apply in May
Endorsed too lateEndorsement process runs past the visa expiryNo valid permission to switch from
Missing a third conditionEndorsement in date, visa valid, but course not completeStudent switching requirement not met

The third row matters for students. Guidance requires students to have completed the course on their CAS, or for PhD students at least 12 months of the PhD, before switching. If course completion is late, it can squeeze the endorsement window. See proving course completion.

Work backwards, not forwards

The safest way to plan is to start at the fixed date and count backwards.

  1. Start with your visa expiry date.
  2. Choose a latest safe application date comfortably before it. Do not plan to apply on the last day.
  3. Mark the 3-month window before that date. Your endorsement letter needs a date of issue inside it.
  4. Add the endorsing body's process before that window. There is no official fixed timeline for endorsement, so ask the body for its typical process and build in slack.
  5. Add your preparation time for the business plan and evidence before you approach the body.

Allow for the decision wait

GOV.UK says in-country decisions usually take 8 weeks. Build that wait into your business plans, such as when you expect to sign a lease or hire, and take advice on your position if your current visa will expire while the application is pending. The Home Office fees table lists priority service at £500 and super priority at £1,000. GOV.UK says a faster decision may be available; check availability for your application type before relying on it.

Graduates: the 2027 change adds a third date

GOV.UK says the Graduate visa lasts 2 years for applications made on or before 31 December 2026 and 18 months for applications on or after 1 January 2027. For students deciding between applying for the Graduate visa and switching straight to Innovator Founder, 31 December 2026 is a planning date in its own right. See Graduate visa or Innovator Founder for a step-by-step approach.

If something is missing when you apply

For missing items that can be fixed, such as the Immigration Health Charge not being paid for the full period, guidance says caseworkers normally write to let the applicant fix it. An expired endorsement letter is a different matter: it is a dated document from a third party, and you cannot fix its date of issue yourself.

Extensions and settlement follow the same logic

The 3-month discipline continues after your first grant:

  • Extensions. You can extend for another 3 years, with no limit on extensions, but a new endorsement is needed each time.
  • Settlement. The settlement guidance requires an endorsement letter no more than 3 months old, alongside the other settlement requirements.

So the habit of working backwards from your permission end date is worth building now. Our guide to contact point meetings covers the checkpoints between grant and extension.

Quick checklist

  • Visa expiry date noted, with a safe margin before it
  • Endorsement letter date of issue inside the 3 months before your application
  • Endorsement not withdrawn
  • Course completion evidenced (students) or 12 months of PhD (PhD students)
  • Fee, healthcare surcharge, biometrics and passport ready
  • Decision time built into your business plans

Key takeaways

  • Your endorsement letter must be issued no more than 3 months before your application date and must not be withdrawn.
  • Apply while your current permission is valid; suitability rules require you not to be in breach of immigration law.
  • Work backwards from your visa expiry to a safe application date, then fit the endorsement window inside it.
  • In-country decisions usually take 8 weeks; priority (£500) and super priority (£1,000) are listed in the fees table.
  • The same 3-month discipline applies to settlement letters, and extensions need a new endorsement.
