Most students who want to switch to the Innovator Founder visa from inside the UK must first complete the course on their Confirmation of Acceptance for Studies (CAS). PhD students are treated differently. Home Office caseworker guidance says they must have completed at least 12 months of the PhD.
That creates an option most students do not have: moving onto a founder route partway through a doctorate. For researchers whose work has turned into a business idea, it is worth understanding exactly what the rule says, what it does not say, and the trade-offs involved.
What the guidance actually says
The rule is short. For students switching in-country:
| Student type | Requirement before switching |
|---|---|
| Most students | Completed the course on their CAS, or one covered by ST 27.3 of Appendix Student |
| PhD students | Completed at least 12 months of the PhD |
For the standard case, caseworkers check the CAS end date but may accept earlier completion shown by evidence such as a results transcript. The guidance points we have checked do not describe a separate checking method for the 12-month PhD point, so do not assume a particular document will be accepted. Keep clear records of when your PhD started and your continuous enrolment, and confirm the current evidence expectations before you apply.
Practitioner commentary dates student switching to 25 November 2025, following Statement of Changes HC 1333. For the background, see students switching to Innovator Founder.
The rest of the application does not get easier
Being a PhD student shortens the study requirement. It does not change anything else. You still need:
- An endorsement. The endorsing body must be satisfied your plan is innovative, viable and scalable, and must confirm you meet the new-business criteria.
- A day-to-day role. Guidance requires you to have a day-to-day role in the business and to be the sole founder or an instrumental member of the founding team. An applicant who is only investing is refused.
- 70 points. 30 for the business plan, 20 for innovative, viable and scalable, 10 for English at B2 and 10 for the financial requirement.
- Suitability. You must not be in breach of immigration law or on immigration bail, apart from limited exceptions.
If your PhD is funded by a government or international scholarship agency award covering both fees and living costs, and you held it in the 12 months before applying, you will need written consent from that sponsor. Check the terms of your funding against this. See the scholarship sponsor consent rule.
Practical implications for research founders
Your research is evidence, not the business plan
Endorsing bodies look at whether you have, or are actively developing, the skills, knowledge, experience and market awareness to run the business. A year or more of doctoral research in the relevant field can be strong evidence on that point. But the plan itself has to show market need, a realistic route to customers and potential for job creation and growth. A technical breakthrough with no customer evidence is not yet a business plan.
Think about intellectual property early
University IP policies vary, and this article does not cover them. If your business is based on research done at a university, find out early who owns the resulting IP and whether you need an agreement with the institution. An endorsing body is likely to ask how the business can use the technology it is built on.
Decide what happens to the PhD
Innovator Founder conditions permit study, subject to the Academic Technology Approval Scheme (ATAS) where it applies. That means switching does not necessarily mean abandoning the doctorate. But the route also expects you to be actively running the business, with contact point meetings normally around 12 and 24 months where your progress is checked. Running a company and completing a PhD at the same time is a heavy load, and slow business progress can put your endorsement at risk.
Switch at 12 months, or finish and take the Graduate visa?
Doctoral graduates have another path. GOV.UK lists a 3-year Graduate visa for PhD and doctoral graduates, compared with 18 months for standard Graduate visa applications from 1 January 2027.
| Option | When it may suit | Trade-off |
|---|---|---|
| Switch after 12 months of the PhD | Business is ready to be endorsed now and momentum matters | You run a business alongside an incomplete PhD |
| Finish the PhD, then Graduate visa | Business needs more development time | A later start on the founder route |
| Finish the PhD, then switch directly | Business is ready at the point of completion | You must time endorsement to your student visa expiry |
There is no right answer in the rules. The question is how ready the business is and how much time you can realistically give it.
Before you decide
- Confirm your PhD start date and that you have completed at least 12 months.
- Check whether scholarship sponsor consent applies.
- Talk to your supervisor and university about IP and about continuing the PhD alongside a business.
- Test whether your plan is ready for endorsement. A free assessment is one quick way to find the gaps.
- Map your dates using our guide to the 3-month endorsement window.

Key takeaways
- PhD students can switch to Innovator Founder in-country after completing at least 12 months of the PhD; other students must complete the course on their CAS.
- Every other requirement still applies, including endorsement, 70 points, English at B2 and suitability.
- Keep clear evidence of your PhD start date and enrolment; do not assume a specific document will be accepted.
- Fully funded scholarship holders need the sponsor's written consent if the award was held in the previous 12 months.
- Study is permitted on Innovator Founder, subject to ATAS, but slow business progress can lead to endorsement being withdrawn.
