Settlement on the Innovator Founder route is not a rubber stamp at the end of three years. It depends on a fresh endorsement letter that confirms specific things about your business, on residence dates you need to have tracked from day one, and on a knowledge requirement that many founders leave too late. None of it is especially complicated, but missing one item can mean a rejected application and a fee you do not get back.

This checklist pulls every settlement requirement from the Home Office caseworker guidance "Innovator Founder" (version 11.0, published 4 August 2026) and the GOV.UK settlement page into one ordered list. Work through it roughly six months before your three-year mark.

Step 1: Confirm your route position

Start with the basics, because they are the easiest to get wrong without noticing.

  • Your last permission must be Innovator Founder. If your most recent grant was on a different route, this checklist does not apply as written.
  • You must be in the UK when you apply. The guidance treats settlement as an in-country application.
  • Use the right form. The guidance names it the "Settlement Innovator" form.

If you came to Innovator Founder from a legacy endorsing body, note one extra rule: a settlement letter from a legacy body is only accepted if it is the same body as your last grant.

Step 2: Check your continuous residence

The guidance requires three years' continuous residence, with no more than 180 days' absence in any 12-month period.

RequirementWhat to check
Qualifying periodThree years' continuous residence
Absence limitNo more than 180 days in any 12-month period
Last permissionInnovator Founder
Location at applicationIn the UK

Build a simple travel log from your passport stamps, boarding passes and calendar. "Any 12-month period" is a rolling test, not a calendar-year one, so check every 12-month window, not just each January to December.

Step 3: Request the settlement endorsement letter early

The endorsement letter is the core of the application. Under INNF 17.1 it must confirm all of the following:

  1. Significant achievements, judged against the business plan assessed in your previous endorsement.
  2. The business is registered with Companies House and you are listed as a director or member.
  3. The business is active and trading.
  4. The business is sustainable for at least the next 12 months, based on its assets and expected income weighed against current and planned expenses.
  5. You have an active, key role in its day-to-day management.
  6. At least two of the seven business criteria in Step 4 are met.

The letter must be no more than three months old on the date you apply. That means the timing is a two-sided problem: ask too late and you may run out of time; ask too early and the letter expires before you submit. See our guide to the three-month endorsement letter window.

Step 4: Identify your two of seven criteria

The guidance lists seven criteria. You need at least two.

#Criterion
iAt least £50,000 invested and actively spent furthering the business
iiCustomer numbers at least doubled within the most recent three years, and currently higher than the mean for comparable UK businesses
iiiSignificant research and development activity, and an application for UK intellectual property protection
ivMinimum annual gross revenue of £1 million in the last full year of accounts
vMinimum annual gross revenue of £500,000 in the last full year, with at least £100,000 from exporting overseas
viThe equivalent of at least 10 full-time jobs for settled workers
viiThe equivalent of at least 5 full-time jobs for settled workers, each with a mean salary of at least £25,000 a year gross, excluding allowances

Three rules apply across the list:

  • No double counting. The same criterion cannot count twice. £100,000 invested is still one criterion.
  • Team members cannot share the same means. If two co-founders both rely on the jobs criterion, the business needs 20 jobs, not 10.
  • Job criteria have their own tests. Each job must have existed for at least 12 months and comply with UK law, including the National Minimum Wage Act 1998 and the Working Time Regulations 1998, among other conditions.

Each criterion has its own detail. We cover them individually: investment, customers, R&D and IP, revenue and exports and jobs.

Step 5: Meet the Knowledge of Life in the UK requirement

The guidance requires the Knowledge of Life in the UK requirement to be met unless you are aged 65 or over. For most applicants that means passing the Life in the UK test, which costs £50 according to the Home Office fees table. Book it well before your target application date, so a resit does not push your timeline back. Our Life in the UK test guide covers the timing.

Step 6: Clear suitability and budget for the fee

Suitability applies at settlement as at every other stage. The guidance says you must not be in breach of immigration law (subject to limited overstaying exceptions), and anyone on immigration bail does not meet suitability except where the Rules allow. The fit and proper person test can also lead to refusal where there are serious investigations or proceedings relating to financial crime or misconduct, or sanctions such as director disqualification.

Then budget. From 8 April 2026:

ItemFee
Indefinite leave to remain (Innovator Founder)£3,226
Life in the UK test£50
Priority service (optional)£500
Super priority service (optional)£1,000

The table covers Home Office fees only. Ask your endorsing body early whether it charges for assessing you for a settlement letter, and how much. Our ILR cost breakdown covers this in more detail.

Step 7: Assemble and submit

Before you submit, run a final check:

  • Endorsement letter dated within the last three months, containing all the confirmations in Step 3
  • Two distinct criteria clearly identified, with no double counting
  • Absence log checked against every rolling 12-month window
  • Life in the UK test passed, or age exemption applies
  • Companies House listing shows you as a director or member
  • Fee and any optional priority service paid

If something goes wrong, read why ILR applications get refused before you reapply.

What about earned settlement?

The government's consultation "A Fairer Pathway to Settlement" proposed a 10-year standard baseline with reductions. Practitioner commentary reports that Innovator Founder holders would be able to settle after three years under the proposals, but the government response had not been published as of late September 2026, and none of HC 1691, HC 259 or HC 584 implemented it. For today, the checklist above reflects the rules in force. See where earned settlement stands.
